In a recent trial, defense attorney J. Brendan Kidd recognized the State had failed to prove a necessary element in the prosecutor’s case, resulting in the dismissal of all charges for his client.
Before resting their case, prosecutors did not establish jurisdiction of the crimes in Spokane County, a required element that enables a jury to hear a case. Judge Vance Peterson reviewed the State’s testimony and agreed with Kidd’s motion, dismissing the case with prejudice, meaning the charges could not be re-filed against Kidd’s client.
